The Control of Asbestos Regulations 2006
The Control of Asbestos Regulations 2006 came into force on the 13th November 2006. The introduction of these regulations changed much that was previously covered by the Control of Asbestos at Work Regulations 2002.

You are probably aware that asbestos is now known to be the largest single cause of occupational related deaths claiming the lives of over 4000 innocent people per year in the UK alone.  The HSE now predicts that this number will increase to somewhere in the region 10,000 per annum by 2015. It was therefore considered necessary to further adapt our legislation to combat this prediction.

WHAT IF WE DON’T COMPLY?

Quite simply, you will be in breach of your statutory obligations and legal responsibilities as an employer. The HSE, as part of their national campaign have committed themselves to making in the region of 30,000 visits to companies in the next 12 months alone to ensure, amongst other things, that adequate information and training has been provided about asbestos. 

WHO NEEDS TRAINING?

In accordance with CAR 2006, mandatory asbestos awareness training is required to be given to all employees whose work could forseeably expose them to asbestos. In particular, it should be given to all demolition workers and those in the refurbishment, maintenance and allied trades where the course of their work will disturb the fabric of the building.

DO WE HAVE TO TRAIN?

Exemption from this requirement would apply only where the employer can demonstrate that work will only be carried out in or on buildings free from ACM’S (Asbestos Containing Materials).

This information should be available in the clients Survey / Management Plan which has been a legal requirement since May 2004.

Rember that asbestos has been used in over 3000 products including roof slates, felts, paints, floor tiles, toilet cisterns, wall partitions and even the kitchen sink.

TRADES AT PARTICULAR RISK:

The following trades have been specifically identified by the HSE as being those are liable to disturb asbestos and who must receive training as defined by Section 10 of the Control of Asbestos Regulations 2006.

THEY CONSIST OF ;

General maintenance staff, electricians, plumbers, gas fitters, painters & decorators, joiners, plasterers, demolition workers, roofers, heating & ventilation engineers, telecommunication engineers, fire & burglar alarm installers, computer installers, shop fitters, architects, building surveyors and other such professionals
